Terms of Service

1. Agreement
These Terms of Service ("Terms") govern your access to and use of the Tripwire platform ("Service") operated by Softure UG (haftungsbeschränkt), Scharfenberger Str. 28, 13505 Berlin, Germany ("we", "us", "Company"). By creating an account or using the Service, you agree to these Terms and the Privacy Policy. Together, these documents constitute the entire agreement between you and us regarding the Service.
2. Accounts
You must provide accurate information when creating an account and confirm your email address. You are responsible for maintaining the confidentiality of your credentials and your Anthropic API key, and for all activity under your account. Notify us immediately at customers@softure-ug.de if you suspect unauthorized access.
3. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable regulations.
- Test, scan, or drive applications or systems you do not own or are not authorized to test.
- Attempt to reverse-engineer, decompile, or extract source code from the Service.
- Circumvent rate limits, authentication, per-organization run limits, or security mechanisms.
- Direct the Service at internal, loopback, or cloud-metadata endpoints to access systems you are not entitled to.
- Transmit malware, exploits, or malicious content through the Service.
- Resell or sublicense access to the cloud Service without our written consent.
- Use the Service on behalf of sanctioned entities or in violation of export controls (EU, US OFAC).
Suspension: Upon discovering abuse or a violation of these Terms, we may suspend your account immediately if necessary to protect the Service or comply with law. We will notify you and provide an opportunity to cure within 7 days where practicable.
4. AI Usage & Limits
Tripwire drives and diagnoses tests using your own Anthropic API key (BYOK). You are responsible for your Anthropic costs and for complying with Anthropic's terms. Your plan determines your rate limits and per-organization concurrency; exceeding them may result in throttled requests (HTTP 429). Self-hosted licenses are governed by your separate license agreement.
5. Disclaimers
The Service runs automated end-to-end tests and proposes likely root causes to assist your engineering work. Test results and root-cause suggestions are provided for assistance only and are not a guarantee of correctness, security, or fitness. You remain solely responsible for decisions made using the Service.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
6. Intellectual Property
You retain all rights to the data you submit to the Service (your URLs, suites, and run results). We retain all rights to the Service, its software, documentation, and branding. We may use anonymized, aggregated data for service improvement. We will never use your identifiable data to train AI models.
7. Limitation of Liability
To the maximum extent permitted by law, our total aggregate liability for any claims arising from or related to the Service shall not exceed the greater of: (a) the fees you paid to us in the 12 months preceding the claim, or (b) €500. We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
Exceptions: The limitations above do not apply to: (a) liability arising from our gross negligence or willful misconduct (Vorsatz oder grobe Fahrlässigkeit); (b) claims for personal injury or death caused by our negligence; (c) fraud; or (d) any liability that cannot be limited under applicable German law (BGB).
8. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from: your use of the Service, your violation of these Terms or any applicable law, or the applications and data you test through the Service.
9. Term & Termination
These Terms are effective from the date you create an account and continue until terminated. You may terminate at any time by deleting your organization. We may terminate your account with 7 days' written notice if you breach these Terms and fail to cure, or discontinue the cloud Service with 90 days' notice. Upon termination your access is revoked and we will delete your personal data within 30 days unless retention is required by law.
10. Force Majeure
Neither party is liable for delays or failure to perform caused by circumstances beyond reasonable control, including acts of God, war, pandemics, natural disasters, government actions, internet or power outages, or failures of third-party providers.
11. Modifications
We may modify these Terms at any time. Material changes will be communicated via email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
12. Governing Law & Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes is Berlin, Germany.
13. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
